Cancellation, Refund, and Withdrawal Right Terms and Conditions

1. Introduction and Scope
These "Cancellation, Refund, and Withdrawal Right Terms and Conditions" (hereinafter referred to as "Terms") are prepared to be valid for distance sales contracts relating to the purchase of domain registration, web hosting, e-mail hosting, and all related digital services (hereinafter referred to as "Service" or "Services") offered by TURGUT KALFAOĞLU (hereinafter referred to as "Seller") through the website www.kalfaoglu.net.

2. Right of Withdrawal (Cancellation and Refund)
The consumer has the right of withdrawal in accordance with Law No. 6502 and related legislation. This right applies to natural and legal persons who purchase services for non-commercial or non-professional purposes.

Withdrawal Period: Provided that the Service has not yet commenced and the exceptional circumstances specified below do not exist, the consumer may withdraw from the contract within 14 (fourteen) days from the date of conclusion of the contract (purchase) without giving any reason and without paying any penalty. Method of Exercising the Right of Withdrawal: Consumers wishing to exercise their right of withdrawal must send a written notification (explicit consent) to the Seller using one of the following communication channels within this period. It is the consumer's responsibility to prove that this notification was sent within the withdrawal period.

3. Exceptions to the Right of Withdrawal
As per the law, in the case of Services performed instantly in a digital environment with the explicit consent of the consumer, or services initiated immediately upon the consumer's request, the consumer must not have benefited from the Service free of charge if they exercise their right of withdrawal. In this context;

For services such as domain registration/renewal, which is activated instantly upon the consumer's request and approval, and instant hosting activation, which is provided and made available for use immediately upon the consumer's request and approval, the right of withdrawal is valid before the service is provided. The right of withdrawal cannot be exercised after the service has been activated.

4. Return and Refund Process

Return Request Evaluation Period: Return requests received under the right of withdrawal or due to defective service are evaluated within a maximum of 7 business days from the date they are received by us, and the result is notified to the consumer.
Refund: If the right of withdrawal is exercised properly, the Seller will refund the money to the consumer within 14 days from the date of receipt of the payment, using the same method of payment (credit/debit card refund, etc.). The time it takes for the refund to reach the consumer's bank may vary depending on the banks' operations.
5. Defective Service and Optional Rights
If the service provided is contrary to the basic technical specifications (disk space, bandwidth, uptime guarantee, etc.) stated in the contract or promotional materials, or if it does not provide the expected normal benefit, this may be considered a "defective service". The defect must be reported to the Seller within 30 days from the date the service commenced. In this case, the consumer has the right to:

Request a switch to a new, suitable service package without defects,
Request a price reduction or refund proportional to the defect,
Withdraw from the contract (if the defect fundamentally eliminates the expected benefit of the service).

6. Resolution of Disputes
In disputes arising between the Seller and the consumer that cannot be resolved amicably, the consumer has the right to first apply to the Consumer Arbitration Board. This application is made to the Provincial Directorate of Trade in the consumer's place of residence, the Seller's place of residence, or the place where the contract was concluded.
